ASHTABULA, Ohio (AP) — Authorities say a soap opera actor's blood-alcohol level was over the legal limit when he crashed his vehicle in northeast Ohio last month.

"Days of Our Lives" actor Freddie Smith sustained minor injuries in the Oct. 7 crash near Ashtabula, which is about 55 miles northeast of Cleveland. The State Highway Patrol says the 26-year-old Smith failed to negotiate a curve and drove into a culvert, flipping the car.

The patrol confirms that Smith's blood-alcohol level was .093 at the time of the crash. The legal limit in Ohio is .08.

Smith's passenger, Alyssa Tabit of North Hollywood, California, suffered critical injuries in the crash but is recovering.

Patrol officials say the case has been transferred to the county prosecutor.
